What the FTC Funeral Rule Is

The Funeral Rule, formally known as the Funeral Industry Practices Rule, is a federal regulation enforced by the Federal Trade Commission (FTC) that governs the practices of funeral providers in the United States. It was first established in 1984 and applies to any person, partnership, or corporation that sells both funeral goods and funeral services to the public.

Its foundational principle is simple: consumers have the right to select and pay for only the funeral goods and services they actually want, and they have the right to know the price of each item before committing to any purchase.

Your Key Rights Under the Funeral Rule

The Right to an Itemized General Price List

Every funeral home is required to provide you with a General Price List (GPL) a printed, itemized list of all the goods and services they offer, with the price of each. The GPL must be provided to you at the beginning of any in-person discussion about funeral goods, services, or prices. It is yours to keep. You are not required to ask for it the funeral home must give it to you.

The GPL must include itemized prices for at least 16 categories of goods and services, including basic services of the funeral director and staff, transferring remains, embalming, use of facilities for viewing or ceremony, direct cremation, and alternative containers. The FTC has been actively discussing requiring online price disclosure as part of a modernization of the Funeral Rule a change that is still under consideration as of 2026.

The Right to Purchase Only What You Want

The Funeral Rule prohibits funeral homes from requiring you to purchase a package of goods and services as a condition of obtaining any particular item. You have the right to buy à la carte to choose only the specific services and merchandise you want and to pay only for those items.

The one exception is the Basic Services Fee: a non-declinable fee covering the funeral director's core professional services and overhead. This is the only fee a funeral home can require you to pay regardless of what other services you select.

The Right to Use Your Own Casket or Urn

If you purchase a casket or urn from another source a third-party retailer, an online vendor, or a family member the funeral home is required by law to accept it. They cannot charge you a 'handling fee' for using an outside casket, nor can they refuse to use it. Major retailers including Costco, Amazon, and others now sell caskets and urns. Your funeral home must accept them.

The Right to Price Information by Phone

The Funeral Rule requires funeral homes to provide price information by telephone to anyone who asks without requiring you to come in person first. If a funeral home refuses to give you pricing information over the phone, they are in violation of the law.

The Right to Know What Is and Is Not Required by Law

Embalming is not required by Tennessee law for any funeral. The Funeral Rule requires funeral homes to disclose this fact in writing on the GPL and in the arrangement conference. A funeral home may require embalming as a condition of a particular service such as a public viewing but they must tell you this in writing, and they cannot embalm without prior authorization.

Similarly, outer burial containers (vaults or grave liners) are not required by Tennessee state law, though individual cemeteries may require them. The Funeral Rule requires this disclosure.

A Written Statement Before You Pay

At the conclusion of any arrangement conference, before you pay anything, the funeral home is required to provide you with an itemized written statement sometimes called a Statement of Funeral Goods and Services Selected listing every item you have chosen and its price. What kind of service? Burial or cremation? Open casket? Which music? What does the obituary say? How do we pay for this?

Many of those decisions could have been made in a quiet room, months or years earlier, by the person whose life it was with no pressure, no grief, and no clock running. That is what pre-planning is. It is a gift you leave for the people you love.

That occasional question has become a regular one. And it deserves a serious, informed answer.

The benefits available to veteran families are real, meaningful, and often significantly underutilized not because families don't want them, but because no one gave them the information in time.

This article is for every veteran in Middle Tennessee and every family member who loves one. It covers what the VA provides, what Tennessee state benefits are available, how military honors work, and the single most important document every veteran should locate today

The DD-214 is the most important document a veteran's family will ever need.

Most families don't know where it is until they desperately need it.

The DD-214: What It Is and Why It Matters

The DD-214 — formally called the Certificate of Release or Discharge from Active Duty — is the official government record of a veteran's military service. It documents branch, dates of service, character of discharge, and awards received. For funeral and burial purposes, it is the document that establishes eligibility for virtually every veteran benefit.

Here is the problem: many veterans stored their DD-214 decades ago and have not thought about it since. Many families discover, in the worst possible moment, that they cannot find it.

If You Cannot Find the DD-214

Replacement copies can be requested through the National Archives' National Personnel Records Center (NPRC) in St. Louis. The process can be initiated online at archives.gov, by mail using Standard Form 180, or in some cases through your funeral director. However, this process takes time often several weeks. Do not wait until you need it.

What Every Veteran Should Do Today

File a copy of your DD-214 with the Dickson County Register of Deeds. This is free, takes less than 15 minutes, and creates a permanent, accessible public record. When your family needs it at any hour, on any day they can obtain it from the county. Every Tennessee county register of deeds office provides this service.

VA Burial Allowances — What the Federal Government Provides

The Department of Veterans Affairs provides monetary burial allowances to help offset the cost of a veteran's funeral and burial. These amounts were updated effective October 1, 2025, and are as follows:

2025–2026 VA BURIAL ALLOWANCE AMOUNTS (Effective Oct. 1, 2025)

Non-service-connected death: Up to $1,002 for burial costs + up to $1,002 for a plot (if not buried in a national cemetery) Service-connected death: Up to $2,000 for burial costs Veteran who died in a VA facility: Up to $1,002 burial + $1,002 plot allowance Headstone or marker: Up to $441 for veterans who died on or after October 1, 2025 Source: U.S. Department of Veterans Affairs, va.gov/burials-memorials/veterans-burial-allowance/

It is important to note that these are reimbursement benefits you typically pay first and are reimbursed. The application must generally be filed within two years of the veteran's burial. Do not delay.

Military Honors — What Your Veteran Is Entitled To

Under the Veterans Funeral Honors program, the Department of Defense is required to provide military funeral honors for eligible veterans at no cost to the family. This is a legal entitlement, not a discretionary benefit.

What Military Funeral Honors Include

At minimum, military funeral honors consist of the folding and presentation of the U.S. flag and the playing of Taps. The flag is presented to the next of kin with the words: 'On behalf of the President of the United States, the United States [branch of service], and a grateful nation, please accept this flag as a symbol of our appreciation for your loved one's honorable and faithful service.'

Additional honors including a rifle party, color guard, and additional military personnel are subject to availability and are arranged through the veteran's branch of service. Your funeral director coordinates these honors; you do not need to contact the military directly.

The Bugles Across America Program

Because the number of active-duty military available to perform honors has sometimes been limited, the Bugles Across America program provides trained volunteer buglers to play a live version of Taps at veteran services across the country, including in Middle Tennessee. Ask your funeral director about this option if a live bugler is important to your family.

Tennessee Veterans Cemeteries

Tennessee maintains state veterans cemeteries that provide burial at no cost to eligible veterans. Tennessee currently operates four state veterans cemeteries:

• East Tennessee State Veterans Cemetery (Knoxville) — two locations

• Tennessee State Veterans Cemetery at Parkers Crossroads (Henderson County)

• Middle Tennessee Veterans Cemetery (Nashville area)

Eligible spouses may be buried alongside veterans for a nominal fee (currently $700). Pre-registration is available and strongly encouraged — it eliminates paperwork and delays at the time of need. According to the National Funeral Directors Association's 2025 Cremation & Burial Report, the U.S. cremation rate has reached 63.4% more than double the burial rate of 31.6%. The NFDA projects that by 2045, cremation will account for 82.3% of all final dispositions.

Middle Tennessee has not been immune to this shift. At Spann Funeral Home, we now see a cremation rate approaching 55% of the families we serve and that number continues to rise. What has not kept pace with this trend is public understanding of what cremation actually involves, what it costs, and how to choose a cremation provider wisely.

This article is my attempt to close that gap. No sales pitch. No pressure. Just honest, accurate information from a licensed funeral director who has been serving Dickson County families since 2001.

The question I hear most often is not 'what does cremation cost?' — it's 'what actually happens?

What Cremation Actually Is

Many families choose cremation while still wanting a formal opportunity to gather, grieve, and honor their loved one. A memorial service held either before or after the cremation can be conducted in our chapel, at a church, outdoors, or at any location meaningful to the family. The body may not be present at a memorial service held after cremation, but the urn containing the remains can serve as a focal point.

Full Funeral Service Followed by Cremation

Some families wish to have everything a traditional funeral service provides including a viewing and visitation, a formal funeral ceremony, and in-person attendance but prefer cremation over burial. This option, sometimes called 'cremation with viewing,' provides the fullest service option while still concluding with cremation rather than burial.

What Cremation Costs in Tennessee

Pricing varies significantly based on the provider and the level of service selected. According to NFDA data, the national median for a funeral with cremation, viewing, and service was approximately $6,280 as of the most recent reporting period not including cash advances like death certificates.

Direct cremation is priced significantly lower. Discount cremation providers in Tennessee and elsewhere advertise prices as low as $995 to $1,295 for direct cremation. These prices are real but so are the differences in what they include and how the service is delivered.

What Happens to the Remains?

Tennessee law provides families with several legally recognized options for the handling of cremated remains:

• Kept in an urn at home — legal and common; there is no requirement to bury or scatter remains

• Burial in a cemetery — cremated remains may be buried in a traditional grave or placed in a columbarium niche

• Scattering on private land — with the permission of the landowner; there are no Tennessee laws prohibiting scattering on private property

• Scattering at sea or in water — permissible with applicable federal maritime regulations observed
